CASE: Client lost his expensive rock cutting equipment to lessor’s conversion of it

CLIENT: Local businessman with rock cutting equipment and expertise

PROBLEM: Verbal agreement left client and his lessor of his equipment in dispute over who was to pay for the maintenance of the equipment. Verbal agreements are difficult to enforce because normally there is dispute over the terms of the agreement without a writing to settle the problems for the trier of fact.

SOLUTION: Mr. Bushman sued the lessor for conversation of client’s equipment and during deposition discovery the parties decided to resolve their differences with the lessor giving back the client’s equipment and the client purchasing some further needed assets from the lessor.

AWARD: Settlement without trial of return of rock cutting equipment.
